Abstract

Indigenous culture composes a right for the people identified with it. Over time, changes occur, and the survival of the cultures requires improvement and maintenance, which does not mean that an indigenous person ceases to belong to their people. Based on the premise that stereotypes violate image and generate damage to indigenous persons, the research adopts the deductive method, with a review of the legal literature and legislation on the subject. It`s concluded the indigenous culture is a differential, which cannot harm them in relation to hegemonic social pattern of society.
